Terms of Service
Welcome to TickDudes. These Terms of Service ("Terms") govern your access to and use of our website at tickdudes.com (the "Site") and the pest control services arranged or provided through TickDudes (the "Services"). By using the Site or requesting Services, you agree to these Terms. If you don't agree, don't use the Site or Services.
1. Who We Are
"TickDudes," "we," "us," and "our" refer to TickDudes, the operator of this Site. TickDudes connects Missouri homeowners with tick, mosquito, and related pest control services, which may be delivered directly by TickDudes or by licensed local fulfillment partners working with us.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to request Services. Services are currently available in Missouri. By requesting a quote, you confirm you have authority to schedule pest treatment at the property address you provide.
3. Quotes and Estimates
Prices quoted on the Site or by our team are estimates based on the information you provide. Final pricing may change based on property size, conditions on site, infestation severity, and access. We'll confirm pricing with you before performing work, and you may decline at no charge.
4. The Satisfaction Guarantee
If pests return between scheduled treatments, contact us and we'll re-treat at no charge within a reasonable time. If you're still not satisfied after a re-treatment, we'll refund the cost of that visit. This guarantee covers the pests we agreed to treat and excludes new infestations from species not covered by your plan, structural damage, or untreated areas of your property.
5. Scheduling, Cancellations, and Access
You agree to provide reasonable access to the property at the scheduled service time, secure pets, remove obstacles from treatment areas (toys, food bowls, etc.), and notify us of any known allergies, sensitivities, or property conditions (beekeeping, fishponds, freshly seeded lawn, etc.) before treatment. You may cancel or reschedule any treatment with at least 24 hours' notice at no charge. Late cancellations or missed appointments may incur a trip fee, communicated in advance.
6. Payment
Payment is due at the time of service unless otherwise agreed in writing. We accept the payment methods listed at booking. If a charge is declined, we may suspend further service until the balance is resolved. You're responsible for taxes that apply to the Services in your jurisdiction.
7. Communications
By submitting a quote request or booking Service, you agree that TickDudes (and our service partners on our behalf) may contact you by phone, email, and — if you've opted in — SMS, for purposes related to your quote and Services. SMS use is governed by our SMS Terms.
8. Your Content
Any information, photos, or notes you submit to us through the Site or otherwise (for example, photos of pest activity in your yard) — you grant us a non-exclusive license to use them to deliver the Services and improve them. You confirm you have the right to share that content with us.
9. Intellectual Property
The TickDudes name, logo, copy, and design on this Site are owned by TickDudes. You may not copy, scrape, reproduce, or create derivative works of any of it without our written permission. Nothing on the Site grants you any license or right to TickDudes trademarks.
10. Disclaimers
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, TICKDUDES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that pest control treatments will eliminate 100% of pests, or that bites will be entirely eliminated — pest pressure depends on weather, geography, and conditions outside our control.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TICKDUDES' TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO TICKDUDES IN THE 12 MONTHS BEFORE THE CLAIM AROSE. TICKDUDES IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
12. Indemnification
You agree to indemnify and hold harmless TickDudes, its partners, and their personnel from any claims, damages, or expenses arising from your breach of these Terms, your misuse of the Site or Services, or your violation of any law or third party right.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws principles. Any dispute will be brought exclusively in the state or federal courts located in Missouri, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date above. Continued use of the Site or Services after changes constitutes acceptance.
